Building Defect Documentation: How to Build a Legal-Ready Evidence Pack

If you ever need to take your builder to NCAT, file a Fair Trading complaint, or make an HBCF claim, the quality of your documentation will make or break your case. Tribunals don't care about your feelings — they want evidence.

What Makes Evidence "Legal-Ready"?

For evidence to be useful in a tribunal or dispute resolution process, it must be:

• Contemporaneous: Recorded at the time the defect was discovered, not weeks later from memory
• Specific: Describes the exact defect, its location, and why it doesn't comply
• Photographic: Clear photos showing the defect in context
• Dated: Timestamped to prove when the defect was found
• Organised: Systematically filed so it can be presented clearly

How to Document a Defect Properly

Step 1: Take Multiple Photos

For each defect, take at least 3 photos:

1. A wide shot showing the room/area for context
2. A medium shot showing the defect location
3. A close-up showing the defect detail

Include a ruler or known object for scale where relevant.

Step 2: Write a Clear Description

Describe:

• What the defect is (e.g., "crack in render extending 1.2m vertically")
• Where it is (e.g., "external west wall, 2m from northwest corner")
• When you discovered it
• What standard it violates (e.g., "does not comply with AS 2311 clause 4.3")

Step 3: Classify the Severity

• Critical: Structural, safety, or waterproofing issue
• Major: Significant defect affecting function or appearance
• Minor: Cosmetic issue or minor non-compliance

Step 4: Record the Builder's Response

Document every communication with your builder about the defect. Save emails, text messages, and written notices. Note dates you reported the defect and any promises to rectify.

Common Documentation Mistakes

• Taking photos without timestamps (turn on your phone's location/date stamp)
• Describing defects vaguely ("the wall looks bad" vs "15mm horizontal crack in brick mortar joint")
• Not recording the builder's response or lack thereof
• Waiting too long to document (memory fades, conditions change)
