How to Handle Construction Variations Without Getting Ripped Off

Construction variations are one of the biggest sources of conflict between homeowners and builders. A variation is any change to the original scope of work in your building contract โ€” and they can add up fast.

What Counts as a Variation?

Common variations include:

  • Changes requested by the homeowner (e.g., upgraded kitchen benchtop)
  • Changes required due to site conditions (e.g., rock removal)
  • Changes required by council or regulatory requirements
  • Errors or omissions in the original plans

Your Rights Under NSW Law

Under the Home Building Act 1989 (NSW):

  • All variations must be in writing and signed by both parties before the work is done
  • The variation must describe the work, the additional cost, and any time extension
  • The builder cannot charge for a variation that wasn't agreed to in writing
  • You can dispute variations at NSW Fair Trading or NCAT

Common Variation Traps

The "Unforeseen Conditions" Trap

Some builders deliberately leave out items they know will be needed, then charge them as variations. For example, they might not include rock excavation in the quote, knowing full well that your site has rock.

The Verbal Agreement Trap

"We discussed this on site and you agreed." Without written documentation, you have no protection. Never agree to any change verbally.

The Prime Cost (PC) and Provisional Sum Trap

Builders can use unrealistically low PC and provisional sums to win the contract, then inflate them later. Always ask for detailed breakdowns of what's included in each allowance.

How to Manage Variations Properly

  1. Demand written variation orders for every change, no matter how small
  2. Get itemised pricing โ€” don't accept lump sums without a breakdown
  3. Track cumulative costs so you know the running total at all times
  4. Compare to market rates โ€” builders often inflate variation prices because they know you're locked in
  5. Never sign under pressure โ€” take time to review and get independent advice if needed
